Law severely restricting the rights of Foster parents may be overturned

There are restrictions on our Second Amendment right. Many of those restrictions amount to straight up infringement. In order to infringe on something, the threshold is actually very low. Illinois is not known for being a state all that friendly to gun owners. They have and continue to obstruct the law-abiding from exercising their Constitutional right. A peculiar case from 2018 out of the Prairie State was appealed to the Seventh Circuit in early 2022. The case is Miller v. Smith and involves the Millers being prohibited from keeping and bearing arms at their property because they are licensed foster caregivers. Recently the Second Amendment Foundation (SAF), who’s suing on behalf of the Millers, filed their reply brief in the appeal. The SAF is suing alongside the Illinois State Rifle Association and Illinois Carry.

Here is what the law does

The law in Illinois is overreaching and bans the possession of firearms at multiple locations, including licensed daycare and foster care properties. Per the opinion from Illinois Central District Court of Springfield, the following regulation was cited:

DCFS has also promulgated the following rule regarding firearms in foster family homes
(o) Any and all firearms and ammunition shall be stored and locked up separately at all times and kept in places inaccessible to children. No firearms possessed in violation of a State or federal law or a local government ordinance shall be present in the home at any time. Loaded guns shall not be kept in a foster home unless required by law enforcement officers and in accordance with their law enforcement agency’s safety procedures.

In other words, the guns should be stored in such a manner as to render them useless in many situations where quick access to hem is crucial. Go read the whole piece at Bearing Arms

She has private security, but you? Me? WE should give up our guns

NSSF’s Larry Keane points out, she spends thousands on private security.

Georgia Democratic gubernatorial nominee Stacey Abrams denied she lost her last bout against Republican Gov. Brian Kemp in 2018. She’s trying again and there’s no denying her gun control agenda would be a disaster for Georgians’ Second Amendment rights.

Abrams’ antigun platform isn’t the only problem. Her Second Amendment hypocrisy is what should have Georgians hopping mad.

Abrams has spent more than $1.2 million on private armed security all while calling for Georgians to give up their rights to protect themselves.

For Me, Not For Thee

Abrams’ anti-Second Amendment platform is well known. She spent a decade in the Georgia state legislature, including six years as Democratic minority leader, where she championed gun control. She introduced gun confiscation legislation deemed “some of the strictest gun regulation in the nation.”

Typical Statist, rules for the common folks, but the elite? Oh no!

CNN fears SCOTUS might erase gun control across America…….

CNN’s Tierney Sneed pointed to the June 23, 2022, SCOTUS decision in NYSRPA v. Bruen, noting that it not only struck down New York’s proper cause requirement but also set forward stringent rules for how lower courts must decide cases related to the Second Amendment.

On July 1 Breitbart News noted that SCOTUS remanded a number of cases, vacating the decisions and ordering them to be reconsidered in light of Bruen. The cases centered on an “assault weapons” ban in Maryland, a “high capacity” magazine ban in California, and carry restrictions in Hawaii, among other things.

Roughly two weeks later Breitbart News pointed to a Washington Times article suggesting the Bruen decision puts all types of gun control in the crosshairs of gun rights groups.

The Washington Times paraphrased Justice Clarence Thomas’s emphasis on the important of decisions like Bruen, McDonald v. Chicago (2010), and District of Columbia v. Heller (2008), saying, “The test courts must apply is whether a firearms restriction would have seemed reasonable to the founding generation that crafted and ratified the Second Amendment. If not, the law must give way to the Constitution.”

In light of this framework for testing restrictions, CNN warns that gun control in every state is in jeopardy:

Since the June ruling, federal judges in at least a half-dozen different cases have already cited the Bruen decision to rule against gun restrictions that have included local assault weapons bans, prohibitions on the manufacture of homemade firearms and bans on older teenagers publicly carrying handguns.
Several other laws now face new legal challenges under the precedent, among them zoning restrictions barring shooting ranges, licensing and training laws and the federal ban on certain misdemeanor offenders from possessing firearms.

IF CNN is getting the vapors over this, good! CNN is almost exclusively wrong on constitutional issues, so, I am hopeful.

Ted Cruz speaks truth, useless media hardest hit

However, the good senator is under fire for saying something that is actually pretty true.

Newsweek, for example, titled its story on it: “Ted Cruz Says Violence Is ‘Only’ Solution to Violence, Defends AR-15s”

What did Cruz say that was so horrible? Well…

Reiterating his stance against gun control, Republican Senator Ted Cruz said that the “only” solution to violence is violence.

In support of the weapon, Cruz cited the shooting at the First Baptist Church in Sutherland Springs, Texas, in 2017, the deadliest in the state’s history. Nearby resident Stephen Willeford responded to the incident with his own rifle and is credited with helping end the incident which killed 26 people and an unborn child.

“The weapon that Stephen used to stop that was an AR-15,” Cruz said.

The conversation around gun control in the U.S. was reignited in May when an 18-year-old man entered Robb Elementary School in Uvalde, Texas, and opened fire with an AR-15, killing 21 students and staff members, and himself. Cruz was among the Republicans to call for enhanced security at schools in response to the incident, including armed guards and fewer entrances.

Of course, some brain numbed member of the Cult of Gun Control had to dig into the Pit of Eternal Leftist Idiocy and offer this retort: “violence doesn’t solve violence’ To which Cruz responded “It actually is the only thing that does.”

Senator Cruz is correct. Evil people do not stop because we offer them flowers or candy do they? They do evil until they are stopped, and yes it is some form of violence that generally stops them. The cold fact is this. Most people who believe that non-violence is the answer are, for some reason, more upset at good guys stopping violent criminals than at criminals harming others.

Some may think those words are harsh, but consider the man who took out the would be shooter recently at Greenwood Park Mall in Indiana. Recall how some of the leading voices for gun control belittled what he did in saving lives. They were insistent on accusing the hero of breaking laws by carrying a sidearm. Some even assured us that his act was not heroic. Moral Back Ass Wardsness anyone?

Tom Knighton sums it up very well

The truth is that violence isn’t inherently evil or vile. The Holocaust wasn’t ended due to diplomacy. It ended because we shot enough Nazis to liberate the camps. It ended because we visited sufficient violence to end it.

On a more local scale and in more recent history, the shooting at Greenwood Park Mall didn’t end because a private citizen talked nicely to the shooter. It ended because a private citizen shot the SOB before he could kill anyone else.

Some don’t like to hear it, but violence solves plenty.

A three-time felon on bail for one of Illinois’ most serious gun crimes opened fire on a Chicago family’s birthday celebration, shooting a 12-year-old boy in the head this week, prosecutors said. Incredibly, a Cook County judge made Isaiah Renteria pay just $1,000 to get out of jail on a Class X armed habitual criminal charge in November and did not require him to go on to electronic monitoring.
On Friday, Renteria became the 38th person accused of killing or shooting—or attempting to kill or shoot—someone in Chicago while awaiting trial for a felony this year. The alleged crimes involved at least 76 victims, 18 of whom died.

The shooter has been convicted of unlawful use of a weapon (twice) and burglary (twice). In November he was charged as “being an armed habitual criminal and a felon in possession of a firearm.”

AGAIN, bail reform is a horrid thing that hurts innocent people. Yet another badly failed “feel good” idea the left pushes.

Protecting Our Schools- Mike McDaniel

The murders in Newtown, CT, Parkland, FL, Sante Fe, TX, Uvalde, TX and elsewhere have reignited the contrived controversy over school shootings. I say contrived because, thankfully, and despite what the media and anti-liberty/gun cracktivists—I know: one-in-the-same–would have us believe, mass shootings are not increasing in frequency; their numbers remain minute, particularly for schools that empower staff to carry concealed weapons:
Even National Public Radio, an outlet not historically fair to gun owners, the Second Amendment, and realistic means of protecting children and teachers, discovered statistics about the numbers of supposed schools shootings, whether from government or anti-liberty/gun banning organizations, are wildly, falsely exaggerated.
Leftists, despite incontrovertible evidence their simplistic and freedom-destroying solutions—gun bans, “universal background checks,” closing the nonexistent “gun show loophole,” “red flag” laws, magazine capacity bans, “assault weapon” bans and confiscation and “gun free” school zones—do not work, they can’t possibly work–never cease pushing them. They patiently wait and renew their demands whenever a mass murder occurs, hoping to push over-reaching and ineffective legislation through the Congress while emotion might overpower reason. Within 24 hours of two California Deputy Sheriffs being ambushed and gravely wounded, Joe Biden pushed for gun control, citing weapons and magazines not used in that attack:
“What will it take,” they angrily and emotionally demand, “for us to pass common sense gun legislation?” Fortunately, hopefully, it will take a nation willing to disregard fact and logic, and willing to abandon their fundamental rights in exchange for ephemeral promises of safety. We’re not there yet, and no one should mistake willingness to temporarily cooperate in a pandemic—particularly after they’ve learned it was unnecessary and destructive–with willingness to eternally surrender fundamental liberties.
On second thought, such legislation is ineffective only in that it will do nothing at all to prevent school shootings, and even less to stop killers motivated to murder innocents in the future. Such legislation is effective only in limiting and hampering law-abiding American’s right to self-defense, and in putting even more power in the hands of Federal politicians and bureaucrats protected by taxpayer paid armed security, but desperate to deny the same protection to those they believe themselves uniquely suited to rule.

California Rep. Karen Bass (C)ommunist has two guns stolen

Well, well, well, elitism anyone?

Karen Bass is a U.S. Congresswoman who is currently running for office as the Mayor of Los Angeles. She is a hardcore leftist, so much so that she called a prominent Communist Party USA member, not just a friend, but also a mentor. She is consistently in favor of gun control measures. And on Saturday, she announced that someone broke into her home and stole two of her guns:

Candidate for Los Angeles mayor and U.S. Rep. Karen Bass says her home was burglarized overnight.
Bass said Saturday afternoon that her home had been broken into late Friday evening and two firearms were stolen, “despite being safely and securely stored.”

I have no problem whatsoever with Bass possessing firearms. While I disagree with her politically, she’s a law-abiding citizen, and I believe this would be a safer, more polite country if every law-abiding citizen-owned firearms.

The issue, however, is that Bass is not only for gun control, she REALLY supports draconian gun laws that trample the second amendment.

Here’s a list of gun control initiatives Bass supports (culled from here, here, here):

Forcing gun dealers to report all sales to the federal government
Banning magazines holding more than ten magazines
Requiring mandatory background checks for all firearm sales (including private exchanges)
Reinstating the federal assault weapons ban
Requiring background checks to purchase ammunition
Banning “bullet buttons”
Banning lending guns to one’s own family members without a background check
Repealing “stand your ground” laws

Yep, pretty radical if you ask me.

Another foolish mayor calls for gun control

This time it is the city of Birmingham’s Mayor Randall Woodfin, Via Bearing Arms

“I wake up every day thinking how can we address this?” Woodfin said.
At Tuesday’s meeting he had two police officers take in examples of the types of guns that they have confiscated to people could see what they look like – he says the most common ones are mini-Draco’s and the AR pistol. Woodfin said there is no use for them on the streets but harm.

Look, Birmingham may be pretty rough, and the crime statistics say that it is, but just what gun control does Woodfin think will suddenly make this end?

It seems he wants to ban them.

“If you can’t support this ban that’s un-American because the whole idea is public safety,” Woodfin said. “Federal tax dollars, state tax dollars, local tax dollars, the root of what we do is public safety first.”

Un-American to oppose doing something has never worked, just so you can say we did something? Do they ever learn?
